These Terms of Service (“Terms”) govern access to and use of FuelDesk (the “Service”), a cloud-based petrol pump management platform operated by FuelDesk Technologies (“we”, “us”, “our”). By registering an account or using the Service, the business you represent (“Customer”, “you”) agrees to these Terms. If you are accepting on behalf of a business, you confirm that you are authorised to bind it.
1. The Service
The Service provides web and mobile tools to record and manage petrol pump operations, including shifts, meter readings, collections, attendance, stock, expenses, credit customers and reports. Features available to you depend on your subscription plan. We may improve, modify or discontinue features, and will give reasonable notice of any change that materially reduces core functionality of a paid plan.
2. Accounts and users
- You must provide accurate registration information, including business name, contact details and, where applicable, GSTIN.
- You are responsible for all activity under your account, for the users you invite (managers, accountants, attendants) and for the permissions you grant them.
- Keep passwords confidential and inform us promptly of any suspected unauthorised access.
- The Service is intended for business use by fuel retail outlets and is not offered to consumers.
3. Subscriptions, trials and payment
- Plans are billed monthly or annually in Indian Rupees at the prices displayed at the time of purchase. Applicable taxes, including GST, are charged as required by law.
- Free trials, where offered, last for the period stated on the plan. At the end of a trial, continued access to operational features requires a paid subscription.
- Payments are processed by our payment gateway partner (currently PhonePe). A subscription is activated or extended only after the gateway confirms a successful payment. We do not store your card or bank credentials.
- Renewals are not automatic unless you separately authorise recurring payments. A renewal paid before the current period ends is added to the end of that period.
- Except where required by law or expressly stated otherwise, fees paid are non-refundable. If a payment is debited but not confirmed to us by the gateway, it will be handled under the gateway’s reconciliation and refund process.
- If a subscription lapses, operational features are restricted until renewal. Your data is retained in accordance with Section 7.
4. Acceptable use
You agree not to:
- use the Service for any unlawful purpose or to record false or misleading transactions;
- attempt to access data belonging to another customer, probe or bypass security controls, or interfere with the Service’s operation;
- reverse engineer, resell or sublicense the Service except as permitted by law; or
- upload malicious code or content that infringes the rights of others.
5. Your data
You retain all rights in the business data you and your users enter into the Service (“Customer Data”). You grant us a limited licence to host, process and display Customer Data solely to provide, secure and support the Service. Our handling of personal data is described in our Privacy Policy. You are responsible for having a lawful basis to enter personal data of your employees and customers into the Service.
6. Records and calculations
The Service calculates sales, reconciliations and stock from the readings, prices and transactions entered by you and your users. You remain responsible for verifying the accuracy of inputs and for your statutory books of account, tax filings and compliance with oil marketing company and regulatory requirements.
7. Suspension, termination and data retention
- You may stop using the Service at any time. Subscriptions are not pro-rated on early termination.
- We may suspend access for non-payment, for breach of these Terms, or to protect the Service or other customers, with notice where reasonably practicable.
- After termination or prolonged non-renewal, we retain Customer Data for a reasonable period to allow renewal or export on request, after which it may be deleted, except where retention is required by law.
8. Availability and support
We aim to keep the Service available at all times but do not guarantee uninterrupted access. Planned maintenance will, where possible, be scheduled outside peak pump hours. Support is provided through the contact details on our website.
9. Intellectual property
The Service, its software, design and documentation are owned by us or our licensors. Except for the rights expressly granted in these Terms, no rights are transferred to you.
10. Warranties and limitation of liability
The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim implied warranties of merchantability and fitness for a particular purpose. Our aggregate liability arising out of or relating to the Service is limited to the fees paid by you for the Service in the twelve (12) months preceding the event giving rise to the claim. We are not liable for indirect, incidental or consequential losses, including loss of profits, revenue or data, or for losses arising from inaccurate data entered by users.
11. Indemnity
You agree to indemnify us against claims arising from your breach of these Terms or from Customer Data you submit in violation of law or third-party rights.
12. Governing law and disputes
These Terms are governed by the laws of India. Subject to any mandatory provisions of law, the courts at the city of our registered office shall have exclusive jurisdiction. The parties will first attempt to resolve disputes amicably through good-faith discussion.
13. Changes to these Terms
We may update these Terms from time to time. Material changes will be notified through the Service or by email at least fifteen (15) days before they take effect. Continued use after the effective date constitutes acceptance.
